Politician Martha Karua has filed a notice of appeal following the High Court's dismissal of her a petition against Kirinyaga Governor Anne Waiguru's election.

After the ruling on Wednesday, when her petition was termed

"hopeless, defective and incurable",

the Narc Kenya leader declared the fight was not over.

The notice states:

"Take notice that the appellants herein, being dissatisfied with the ruling...intend to appeal to the court of Appeal of Kenya against the whole said ruling."

The notice dated November 16 was also filed by Joseph Gitari who is a petitioner.

Through lawyer Gitobu Imanyara, Karua argued that the August 8 election was not free and fair.

She cited the Supreme Court ruling that nullified the election of President Uhuru Kenyatta for a second term.

But

Justice Lucy Gitari said the petition did not adhere to election petition rules and the Elections Act.

Waiguru, Deputy Governor Peter Ndambiri

and their supporters celebrated outside the court.

The Governor termed the judgment "God's work" and noted her belief in him.

"I knew I would emerge winner since the people spoke

loudly when they elected me," she said.
