Matiba seeks Sh234m in cost for compensation suit

Veteran politician Kenneth Matiba has filed a suit against the state seeking Sh 234 million as legal cost.

Lawyer John Mburu filed the bill of cost of Sh234,614,128.52, being the expenses he incurred since August 31, 2013, on behalf of the former Kiharu MP.

Matiba, 85, was awarded more than Sh1billion in August as compensation for detention and inhuman treatment he underwent at the hands of security agents.

The award was given by Supreme Court Judge Isaac Lenaola who handled the case when he was still a High court judge.

Matiba suffered a serious stroke on May 26, 1991, but remained in detention without medication for one week.

He was arrested during the clamor for an end of the single-party rule during the Moi regime.

The judge said Matiba proved great violations were meted upon him by state agents before he was released on June 4, 1991.

"Real justice can be expensive and nothing in compensation can return Kenneth Stanley Jindo Matiba to the sprightly and fit man that he was before his detention," Lenaola ruled

The judge said the politician's businesses deteriorated while others collapsed owing to his absence at their helm.

The state was ordered to bear 20 percent of Sh471, 664,258.50 Matiba got for loss of his dwindled business empire.

For the torture and inhumane treatment in the hands of state agents, the judge awarded Matiba Sh15 million. He was also given Sh18, 146,631.52 for medical cost.

In his bill of costs, Matiba says the amount include his instruction fees, money spent filing the petition and other corresponding documents , making copies and drawing affidavits among others.

The case will be heard November 15.
