The High Court has reinstated hate
speech and incitement to violence
charges against former Machakos Senator
Johnston Muthama.
Justice Grace Machari made the orders
after the DPP appealed the decision
of the lower court, which had terminated
the charges.
“Muthama shall appear before the
chief magistrate court on October 6 for
purposes of taking hearing dates,” the
judge said.
Machari said she was not persuaded in
any way that the DPP abused his powers
in charging the former senator.
She said, “I find the application by the
DPP merited and the same succeeds.
I set aside the orders of the lower court
issued on July 28, 2016. l substitute it
with an order that the charge sheet filed
by the prosecution before Milimani chief
magistrate court be reinstated.”
