However, clerk Robert Cheruyoit was found by the court to have a case to answer. He will be placed on the defense and a witness called to testify.
Achieng's lawyer David Monger urged the court to order the refund of a Sh20,000 cash bail that the acquitted judge had deposited when the matter came up.
Achieng was charged with soliciting a Sh20,000 bribe through her court interpreter Robert Cheruiyot, of which it was alleged she received Sh10,000.

She was arrested by EACC police officers who raided the court after setting a trap against her.
The case was built on grounds that the magistrate asked a suspect the money to rule a case in the latter's favour.
The two were alleged to have received money from the suspect, who had been accused of running a bar without a trade license.
Cheruyoit's lawyer Lawrence Karanja told the court that the defense will call one witness to testify.
In her ruling, Gicheha ordered that the magistrate’s cash bail be released. Achieng declined to address the press about the acquittal.
The clerk's case will be heard on September 28, 2016
