Naivas Supermarkets managing director has accused his elder brother of changing their father's will to get a lion share of the multi-billion estate.

David Mukuha yesterday told the High Court in Nakuru that his father, Peter Kago had written a will distributing his property to nine children.

He said his first born brother, Newton Kagira has squandered his inheritance and now wants a chunk of his siblings’ property.

Kimani was testifying during the hearing of a succession case in which Kagira has disowned his father’s oral and written will.

He has also objected the administration of their late father’s estate.

Kagira has presented the will in court, claiming it is the genuine one drafted by their father.

Their father founded Naivas.

Kimani told judge Anthony Ndung’u his father drafted a will, indicating how his property would be shared.

“My elder brother, Kagira, received his share of the property distributed among my nine siblings. He squandered it and now he wants a share of what remained for the rest of us,” he said.

Kimani told the court Kagira "lives large and irresponsibly", despite his two brothers who are co-directors of Naivas trying to assist him.

He said Kagira, who is the only one opposed to the will, started wasting the family property when their father was still alive.

“He mismanaged my father’s first shop, Rongai Self Service Store, which had been placed under him. He embezzled Sh230,000,” Kimani said.

In the case, Kagira has accused his siblings of plotting to block him from inheriting his father’s property.

He wants to benefit from his father’s property including, Naivas chain of supermarkets.

Kagira says his exclusion, being the eldest son, was against the Kikuyu culture as he was the custodian.

The suit also seeks to determine who will be the executor of the will.

The hearing continues.
