Sonko picks rejected nominees for CPSB positions again

The names are in his message to the assembly read by the speaker on Tuesday

Governor Mike Sonko has nominated two people - familiar to the county assembly - as his choices to join the Nairobi County’s Public Service Board (NCPSB).

Philip Polland George Kaingu is his pick for secretary to the County Public Service Board while Jack Babji Owino, if approved, will be a member of the board.

 
 

The names are in Sonko’s message to the assembly read by Speaker Benson Mutura on Tuesday.

The governor made the nominations as per sections 58(1)(b) and 58(1) (c) of the County Government Act 2020 which provide for the nomination and appointment of a member and secretary to the County Public Service Board respectively with the approval of the County Assembly from non-MCAs through a competitive process.

Subsequently, Mutura directed the Committee on Labour and Social Welfare to vet the nominees.

Acting Clerk Pauline Akuku published the two nominees' names in the dailies on Thursday. They will be vetted on October 5. 

Kaingu and Owino have in the past been nominees for the same positions.

In July this year, MCAs vetted Kaingu and found him lacking qualifications and experience.

In May 2019, Sonko announced he had picked Owino as a board nominee. But Owino did not appear for vetting.

 
 

Kaingu and Owino are required to forward their particulars - IDs, curriculum vitae, clearance certificates from the Ethics and Anti-Corruption Commission, Kenya Revenue Authority and Higher Education Loans Board, among others - to the vetting committee before September 29.

Sonko had on March 2 forwarded Kaingu's name to the Labour committee for vetting to replace Susan Waweru, who has been acting after Meshack Guto's term ended last year.

The committee found Kaingu, an advocate of the High Court and Bachelor of Laws degree holder, lacking experience to lead thousands of employees. Since 2013, his law firm has had only four employees.

He is not a Certified Public Secretary and does not hold a master's degree. Section 58(1)(c) of the County Governments Act says that the NCPSB should comprise a CPS of good professional standing nominated and appointed by the governor with the approval of the county assembly.

In the 2013 General Election, Owino was the TNA candidate for Homa Bay's Kibiri Ward by-election, but the Independent Electoral and Boundaries Commission barred him from vying.            

Karachuonyo constituency returning officer Joseph Juma declined to clear him because his name was not in the voters’ register.

 “It is a requirement that all the contestants must be registered voters in this ward," Juma said.

The NCPSB is chaired by Thomas Mweu while Aisha Wanjiku, Sharon Mirella and Consolata Muthoni are members.

The board establishes and abolishes offices in the county public service and appoints holders of senior offices.

It also develops and implements human resource policies and framework for the county government.
