A family in Mandera has sued the police and DCI over the disappearance of their kin who went missing in May.
Husein Ibrahim Aliew wants the police to produce his brother Isaack Ibrahim before the court or release him.
Aliew alleged that his brother was kidnapped from his matrimonial house in Bulla Afya location in Elwak subcounty by individuals wearing combat police uniforms and driving three Land Cruisers.
In a habeas corpus filed before the Milimani High Court, Hussein says they are living with anxiety and stress caused by the disappearance of Isaack.
The businessman was reportedly abducted on May 2, from his house in Bulla in the Elwak subcounty.
"In any event, Isaack Ibrahim has an absolute right to habeas corpus and to a fair trial, thus he should be subjected to due process of the law instead of leaving his loved ones worried about his whereabouts," Hussein Ibrahim said.
Hussein through lawyer Danstan Omari says that hours after the ordeal when it became clear that nobody would account for the whereabouts of Isaack, the area chief reported the matter to the Elwak police station and obtained an OB number.
"There is a reasonable fear that he was abducted by officers attached to the respondents who have refused to either allow his family to visit him in custody and/or refused to present him before a court of law to answer to any charge in law," Omari said in court documents.
Omari wants the court to compel the Police IG Japeth Koome and DCI boss Amin Mohammed Ibrahim to produce Isaack before the court or any other court with the requisite jurisdiction.
