Politician Kalembe Ndile was yesterday acquired by a Machakos court on charges of discharging sewerage from his building and being a public nuisance. The Independent Party (Tip) leader was also discharged on another count of failing to comply with the Ministry of Public Health notice. Machakos resident magistrate E.K.Too said the prosecution had failed to establish the particulars of the two charges. He said the evidence shows that Kalembe was availed in court based on information from people who were not disclosed. "Failure by the prosecution to conduct a search on the building owners clearly raises doubts by the prosecution to establish ownership to property," the magistrate said in his judgment.
