Drop the case, says Omtatah
Activist Okiya Omtatah want a case in which he is accused of disrespecting a court dismissed. Omtatah was charged for saying the court was being used like a condom. He told Kibera magistrate BM Ochoi yesterday that he has no jurisdiction to hear the case.
The activist was charged alongside 30 activists in July 2011 for creating disturbance in a manner likely to cause breach of peace on the State House road. The activists were demonstrating to petition the President to sack the then Education Minister Sam Ongeri over Sh4.2 billion scandal.
When they were taken to court, the activists refused to take plea and said the court was being misused. The prosecution opposed the application saying the court has jurisdiction to hear and resolve the matter since the offence was committed within Nairobi county. Ruling will be given on October 2.
