Nandi Hills MP Alfred Keter has won an appeal case challenging nullification of his election by the high court.
Making the ruling on Wednesday, Judge Erastus Githinji on behalf of the appeal judges said there was no evidence that Keter campaigned outside the stipulated time.
On Tuesday, his lawyers led by Otiende Omollo told the appeal bench in Eldoret that High Court judge Kanyi Kimondo erred in law by nullifying the election that was not factual.
The High Court used one ground that Keter campaigned in six places, but we have argued that there was no evidence to that effect,” said Otiende while giving his submission before the judges.
Keter was declared the winner with 28,923 votes against 13,872 garnered by Benard Kitur, the petitioner.
Judge Githinji said results in areas where Keter is accused of campaigning illegally could not affect the overall results of the polls.
He said the difference between Keter's tally and that of Kitur was more than 10,000 votes and that results in the three areas was less than 3,000 votes.
The Appellate court set aside all orders of the high court and declared that Keter was validly elected.
"Kenyans have today witnessed my victory, the
bull is back to parliament," jubilant Keter said outside the court.
He blamed his woes on insiders who disliked him for his
honesty and anti-corruption war.
Keter said Kenyans have witnessed his bounce back and will continue speaking the truth.
"I have faced all this because I speak the truth, I am
being fought by insiders for fighting for the less fortunate especially on the maize scandal," he
said.
The MP said theft in the country has led to great suffering by his constituents.
He said that Uasin Gichu farmers are suffering from non-payments by the cereal board and tea farmers as a few people pocket their bonuses.
He cited health, unemployment, high
standard of living among his people as
a major
challenge facing his supporters.
“Our
neighbours
from Western are growing sugarcane but they are suffering from leakages as corruption has hit the sugar
industries,” Keter
said.
He added that he was in full support of president Uhuru
Kenyatta
fight on corruption pledging to help to fight the vice.
