Trans Nzoia petition: Khaemba rejects vote recount, scrutiny

Trans Nzoia Governor Patrick Khaemba has asked the High Court to decline an application for scrutiny and recount votes.

This followed a petition filed by two voters - Robinson Mwanga and Alfa Chore - who are challenging his August 8 victory.

Through his lawyer Peter Wanyama, the governor on Monday asked Justice Anthony Murima to dismiss the application.

He said this followed the petitioner's failure to name specific polling stations to be scrutinised and the reason for the same.

"The raw data from polling stations was not challenged by four candidates who competed with the governor."

"There has been no complaint from any of the candidates regarding the tally at the polling stations. Therefore, this cannot form the basis of vote scrutiny," the lawyer said.

He said the application was also filed late and hence should be thrown out on technicalities.

Wanyama argued that most of the forms 37A, B and Cwere signed by agents who confirmed the authenticity of the results.

He argued that no agent disputed the results.

IEBC, on the other hand, said there was a wide margin of more than 42,000 votes of which the petitioners cannot challenge.

The commission further argued there was no evidence of flaws since there is no candidate who disputed the results.

The case continues.
