Petitioner after Mwilu, Lenaola attempted to bar Raila from election

Derrick Ngumu, the petitioner seeking the removal of two Supreme Court judges, has in the past pushed to bar NASA's Raila Odinga from vying for president.

Ngumu filed a petition to have Deputy Chief Justice Philomena Mwilu and Justice Isaac Lenaola removed from office on allegations of gross misconduct.

He identified himself as the executive director of Angaza Empowerment Network.

In his petition, Ngumu said Mwilu and Lenaola have violated the Judicial Service Commission's code of conduct.

This, he stated, occurred during proceedings for NASA's petition to nullify the August 8 presidential election, which was a hot contest between Raila and President Uhuru Kenyatta.

Starting April, the

controversial activist wrote letters and filed a petition to have Raila blocked from taking part in last month's election.

He questioned the NASA principal's integrity and academic qualifications.

Using surname Malika and through Human Rights Africa where he was executive officer, Ngumu wrote to the IEBC for investigations into whether Raila satisfied provisions for being president, in line with chapter six of the constitution.

In the letter, the petitioner said the Opposition chief had been adversely mentioned in scandals that placed his integrity into question.

Two weeks later, HRA moved to the High Court to advance the agenda.

Through lawyer Robert Onyango, the organisation raised integrity issues against the NASA flag bearer.

The lobby cited inconclusive investigations into Dominion Farms Limited, Kisumu Molasses Plant, the Kazi Kwa Vijana project and the maize and Triton scandals.

All these were linked to the veteran Opposition leader.

"The petitioners want an order compelling KNEC to ascertain if [Raila's] academic qualifications are genuine and issued by a university recognised in Kenya," Onyango said.

The lawyer further argued Raila has never been publicly cleared of wrongdoing or involvements in the scandals.

HRA asked the court to compel IEBC to carry out its constitutional mandate and and investigate the claims.

Requesting that the electoral agency make public its findings prior to Raila's clearance, the organisation said EACC and the DPP should be roped in.

But his attempts backfired and Raila vied for the top seat for the fourth time. HRA was not immediately available for comment on the progress of this petition and/or whether they will revive it.

On Tuesday, Angaza Empowerment Network said they will give a detailed briefing about the petition on Wednesday at their Mombasa office.

Interviews with multiple sources have since reveled Ngumu enjoys a cordial relationship with NGOs Coordination Board boss Fazul Mahamed. Reports indicate Mahamed might have helped Ngumu register HRA which he unsuccessfully used to bar Raila from poll.

The NGOs board boss neither answered calls nor responded to SMSs for comment on the claims.

Mahamed has been accused of being lenient to regime-friendly NGOs and stamping on those critical of the government.

He ordered Africog and KHRC deregistered when they announced they will challenge Uhuru’s win.

The two moved to court and stopped the orders.
