Willie Kimani murder: Investigator reveals ID of slain lawyer's client

A crime scene investigator on Friday tabled graphic photographs of Willie Kimani's client who is alleged to have been killed by Administration Police officers on June 23 last year.

Constable Bernard Serem said he took the photographs on July 1 after Josephat Mwenda's body was retrieved from River Athi at Ol Donyo Sabuk.

The boda boda rider's body was retrieved alongside that of lawyer Kimani and his taxi driver Joseph Muiruri.

The officer told the court that the body was stashed in a gunny bag and a diver helped retrieve it from the river.

He took horrific photos before and after the body was pulled out of the water.

And after removing it from the bag, the officer said he took more photos, including one of the victim, naked.

"When the body was pulled by the divers from the river, I Immediately took photographs."

"The body was later identified as that of boda boda operator, Josephat Mwenda," he said.

The officer further told the court that from the photographs, it was evident Mwenda underwent torture before he was strangled to death.

"Several parts of the body and head had been hit by a blunt object and his face was covered with a plastic bag."

On trial are four AP officers Fredrick Leliman, Stephen Chebulet, Leonard Maina, and Silvia Wanjiku and an informer Peter Ngugi.

Kimani, an advocate with International Justice Mission, Mwenda and Muiruri disappeared on June 23, 2016.

This was after they attended a hearing at Mavoko law court.

It is believed they were arrested, temporarily held at Syokimau AP camp before they were killed in an open field at Mlolongo.

A witness previously told the court that three police officers, one clad in a traditional Maasai shuka were seen at the suspected killing field the night the three men disappeared.

Serem told Lady Justice Jessie Lesiit that six days after retrieving the body, he was asked to accompany his colleagues to one of the suspects' house where he also took photos.

He said they went to Sergeant Maina’s house, near Mlolongo police station, after which some items linking him to the deaths were recovered in his house.

But the officer was taken to task by the defence lawyers, including Cliff Ombeta, to show how the items were linked to the murders.

Serem also said he was the one who dusted and photographed the container in which the three are alleged to have berm kept before they were brutally murdered.

The officer, however, admitted that he did not find fingerprints or even footprints inside the cell.

Jackson Owino, another witness, said he was the one who recovered Muiruri’s vehicle in Kamirithu, Kiambu county.

The vehicle that was used by the three was recovered on the night of June 23 and 24, 2016.

He said he was on patrol at that night when his boss called informing him of an abandoned vehicle.

The witness said he towed the vehicle to Tigoni police station on that night. The hearing resumes Monday, July 17.
