Nominated MP Oburu Oginga has said the ICC should prosecute Interior CS Joseph Nkaissery over the Wagalla Massacre atrocities he committed when he was a general in the army.

Oburu said Nkaissery dined with ODM to cover crimes he committed when he was in the army.

Nkaissery has previously and on various occassions denied any wrongdoing.

His spokesperson Mwenda Njoka said, “I challenge Oburu to check facts and history to know who was where, when and at what time. He should research on who was doing what operation and when. Nkaissery was not involved in that operation. The matter has even been investigated by various commissions.”

“The Wagalla killings are part of the Truth, Justice and Reconciliation report that forced Nkaissery to ditch ODM when we started pushing for the implementation of the report,” Oburu said.

The nominated MP said Nkaissery committed a serious crime on February 10, 1984, where more than 5,000 people died.

He added that Nkaiserry is alleged to be part of the orchestrators of the extrajudicial killings, a crime he says is only punishable in international courts like the ICC.

Oburu said before Nkaissery goes around the country issuing arrest threats to NASA presidential candidate Raila Odinga to scuttle his bid, he should also be put behind bars over the Wagalla Massacre.

“The Jubilee government is in panic mode because they know the TJRC report is among the issues Raila will tackle when he ascends to power,” he added.

Oburu at the same time told Nkaissery that Raila is not his equal and he should not toy around with his name over arrest threats.

“The CS has equals he can address, like me. He should give Raila peace of mind to campaign, not empty threats,” Oburu said.

The legislator also criticised National Assembly majority leader Aden Duale and Gatundu South MP Moses Kuria over incitement remarks they made separately.

Oburu questioned why the two are not in jail over incitement remarks.

In July 2015, Kuria was questioned by the police over his remarks that anyone opposing the National Youth Service projects should be cut with a panga.

He recorded statements with serious crime investigators at the CID headquarters for close to two hours.

The MP said the media misreported his press briefing at Parliament Buildings, where he apologised for his utterances made in Gatundu during a crackdown on illicit brews.

In January, Duale recorded a statement at the DCI headquarters over an audio clip doing the rounds on social media, believed to be of him inciting youth against Kamba voters and Wiper supporters.

The Garissa Township MP denied the voice was his.

Oburu castigated the Jubilee government for applying the law selectively in favour of Jubilee sympathisers.
