Former Mungiki leader Ndura Waruinge yesterday filed a petition to stop his prosecution for fraud.
He is charged with forciblly dispossessing a person of two prime parcels of land in Ongata Rongai.
But Waruinge accused the Director of Public Prosecutions of taking him to court without evidence.
He opposes the DPP’s decision to institute criminal charges, saying the dispute is civil.
Waruinge is accused of committing land fraud on April 12, 2013. He is accused of claiming land in Rangau

belonging to Kirumba Mwaura.
“If the case proceed as scheduled, my rights to equal protection and equal benefits under the law and my right to own property will be grossly violated,” he says.
The prosecution has listed seven witnesses. Two have testified.
