A hate speech case against Baringo South MP aspirant Amos Ol’empaka failed to kick off after the prosecution yesterday told a Kabarnet magistrate court his case file is missing.
Ol’empaka’s lawyer, Siaya Senator James Orengo, who had just disembarked from a chopper, could not proceed with the matter.
“We honoured the court by appearing as agreed, but were shocked to find the case file was missing. Meaning my client had no case to answer at all. It was just a move meant to intimidate and a political witch-hunt by the state,” Orengo said.
“Jubilee has sensed defeat and is now using police to intimidate strong NASA officials.” Olempaka was summoned by police on Saturday following hate speech allegations on banditry attacks against one of the warring communities.
He was freed on a Sh14, 000 cash bail and asked to appear before the court yesterday.
Baringo North police inspector explained the prosecutor was not around to present the file, and advised

the case be revisited in two weeks. But after consulting with Orengo for an hour, the court agreed to postpone the matter to August 15.
