Meru trader wants Munya barred from vying in August over audit queries

A Meru businessman wants Governor Peter Munya barred from seeking an elective seat during the August 8 polls.

Isaiah Kithinji, in a petition filed at the Meru High court, wants PNU to deny the governor a chance to fly its flag.

He cites misuse of county funds among his grounds for the petition against Munya filed on Tuesday.

IEBC, EACC, Auditor General, PNU secretary general are listed as interested parties in the case.

Kithinji says Munya flouted the law following the audit reports of financial years 2013/2014, 2014/2015.

The petitioner says the governor's administration underutilised Sh2.2 billion from a budget of over Sh5 billion.

"Only Sh650 million was actually spent from the Sh2.8 billion development budget," the petitioner says.

"The reason for failure to absorb the funds was not given," he says following the report for fiscal year ending June 30, 2015.

The petitioner also wants the county government to come clean on a nets and curtains tender worth Sh3.4 million.

Also in question is the justification for Sh4.3 million allocated to the Meru teaching and referral hospital.

Kithinji says the tender was awarded contrary to the threshold matrix set by legal notice No106 of June 2014.

This limits for 'request for quotation method' to the procurement of services and goods not exceeding Sh2,000,000.

The petitioner claims Munya has personally benefited from the county government funds.

"He is an active participant in the mismanagement and plunder of the county government," the petitioner claims.

He also argues that the governor appointed county officers without following due process of the law.

"These were guided by favoritism, ulterior motives and disregarded the employment of deserving and qualified candidates."

Kithinji's counsel Kiogora Mugambi said they have already served governor Munya with the petition.

"We have also copied the same to all the respondents in the case," Mugambi said.

He said the case is not political as the petitioner had approached him long ago over the issues.

"The petitioner approached me a long time ago. We were still collecting evidence to back the petition," Mugambi said.

The governor had faced the to clear the air on the audit queries.

The case is before Lady Justice Adwera Ong’ijo and will be heard on April 5, 2017.
