Kabete MP Ferdinand Waititu has been
acquitted of incitement to violence charges for comments he uttered at Kayole in 2012.
Resident magistrate Joyce Gandani said on Wednesday that the prosecution failed to prove its case against the legislator.
Waititu, then Embakasi MP, was accused of inciting Kayole residents against members of the Maasai community.
The legislator, during protests by residents following the killing of a street boy, demanded that Maasais leave the area.
Residents claimed the boy was murdered by two Maasai watchmen after claims he stole a hen.

After the MP's remarks, residents attacked watchmen, looted and damaged property owned by Maasai traders.
The protests left two watchmen dead, but the court ruled that there was no direct evidence linking the MP to the guards' murder.
Following the charges, Waititu was suspended from the docket of assistant minister for water and irrigation.

The two were among eight legislators accused of alluding to the physical injury and death of Opposition leader Raila Odinga at Kasarani Gymnasium on June 13, 2016.
Milimani senior principal magistrate Charity Aluoch cleared them saying the prosecution failed to prove its case.
