Jubilee, ODM protest 'illegal' IEBC timelines

Jubilee Party and ODM have protested against the electoral body's timeline for the next elections, terming them illegal and hard for candidates to comply.

The two parties blamed IEBC for failing to gazette regulations and guidelines introduced, and complained that the electoral body was using rules not passed by Parliament.

“As a party, we are disturbed that if the trend continues, then Kenyans will not be guaranteed of free, fair and transparent elections," ODM spokesperson Philip Etale said.

"IEBC has ignored the new election laws and continues to overstep their mandate, even as the IEBC Selection Panel works round the clock to appoint a new chairperson and commissioners,” he added.

ODM said IEBC was planning to lock out public servants and other competitive candidates in the coming elections.

“The blatant application of the Election Campaign Financing Act, 2013 without attendant regulations is illegal and unacceptable. To-date, the Regulations have not been passed by parliament and gazetted," ODM's press statement read.

"Therefore we find it uncalled for, for the IEBC to ask people to sign forms which are supposed to be annexes to the regulations that still lie before parliament.”

Speaking for Jubilee, Raphael Tuju noted flaws in the timeline and aspect of the law that IEBC is required to comply with.

“We have since advised all our aspirants to comply with the law even after we have raised our reservations,” he said.

“There are issues of law such as has been alluded to by our competitors. For example, the law refers to candidates and not aspirants. Civil servants are supposed t resign by mid-February and only when they become candidates,” the former Rarieda MP said.

“But we also want to respectfully submit that there is no reason for us to engage in a war of words with our competitors because the real theatre that can resolve these emerging issues is the parliament."

Tuju was speaking at Anniversary Towers after Jubilee party submitted President Uhuru Kenyatta’s details at IEBC Headquarters.
