Court withdraws phone theft charges against Moi's grandson

Phone theft charges against former President Daniel Moi’s grandson were officially withdrawn on Monday by a Nakuru court.

The matter, where Collins Toroitich was worth Sh19,000 from his daughter and friend, will now be settled out of court.

On July 7, Toroitich was accused of stealing the phones from May Chelimo and her friend Betty Chebet during a lunch date at a Nakuru hotel.

Hillary Sungoiyo, the prosecutor, confirmed to the court that he has received directions from the senior assistant Director of Public Prosecutions (DPP) to have the parties settle the matter out of court.

"The defense counsel had on August 11 written to the DPP indicating that the accused was willing to pay for the lost items.

The DPP has directed that the charges be withdrawn under Section 87 (A) of the Laws of Kenya," Sungoiyo told the court on Monday.

In his ruling, chief magistrate David Kemei said that the charges have been withdrawn and ordered Toroitich's release, unless the complainants raise the issue at a future date.

"As the prosecution has requested, the charges have been withdrawn under Section 87 (A) of the Laws of Kenya to give way for the parties to amicably solve the matter out of court," Kemei said.
