Woman jailed four years for stealing three month-old baby

A mother of four who has been jailed for four years.

Nakuru chief magistrate Josephat Burudi ruled that the pre-sentence report indicated that Gladys Wamaitha

was not suitable for probation.

"Parents of the minor went through a lot of pain for a month after they lost their baby girl, her act is unjustified and she deserves four

years in jail," Burudi ruled.

The court heard that the 32 year-old woman stole the baby girl to prove to her boyfriend Boniface Ondiku

that she had borne him a child.

Wamaitha was charged with depriving Grace Wanjiru and Lawrence Waweru the care of their child.

She was accused of committing the offence on July 5 at Kiamunyeki area, Nakuru county when the child's mother went out to buy potatoes.

The baby was left in the care of her mother's sister; the court was told the accused later vanished with the child, and even switched off her phone.

CID detectives traced the child until one month later when the suspect was arrested at her boyfriend's house in Kiti area.

State prosecutor Hillary Songoy had asked the court to consider the case under the victim Act, citing grounds that the accused has no previous criminal record.

On Monday, the court also ruled that she can appeal the sentence within 14 days.
