Sex between cousins is a sin, says ACK head

ACK Archbishop Joseph ole Sapit has criticised the High Court ruling that permits sexual relationships between cousins.

He faulted Siaya judge James Makau for releasing a man who had sex with his paternal cousin. Sapit said the Bible prohibits sex between blood family members.

"The scripture is clear on the rules that govern lives and society. Incest is a sin. Even animal inbreeding is not encouraged," he said.

The clergyman said the ruling was erroneous and the church opposes it completely.

He was speaking at St Marks Primary Teachers’ Training College Kigari on Tuesday when he opened a synod’s pastoral meeting.

The judge released a 28-year-old man who had been jailed for 10 years after being convicted of committing incest with his 16 years paternal cousin noting that the act was not incest.

In 2014, Magistrate Monica Nafula found the man guilty and jailed him for 10 years.

His advocate however appealed against the ruling, claiming that the trial court made a mistake in convicting the accused as the act was not was not incestuous.

The judge said the prosecution failed to prove that the appellant was related to the complainant within the prohibited relationship.
