Naivasha chief magistrate Peter Gesora has summoned State House comptroller Lawrence Lenayapa to appear in court in a case against MPs Alfred Keter (Nandi Hills) and Sonia Birdi (nominated).

Gesora ordered that Inspector General of Police Joseph Boinnet personally serves Lenayapa with the summons.

It emerged that it had become impossible for the prosecution to access State House and serve the comptroller, who is a key witness.

The MPs have been charged with various offences, including creating disturbance at the Gilgil weighbridge on January 24 last year.

They are also charged with abusing security agents in the area while demanding the release of an impounded trailer.

During the hearing, police constable Isaac Mukonabi admitted recording a video clip in which the two MPs can be seen and heard issuing threats at the weighbridge.

The officer, who was at the time stationed at the weighbridge, said Keter almost beat up the duty manager.

Mukonabi said he recorded the altercation for “fun” before posting the footage on his Facebook timeline. The video went viral.

Mukonabi told the court that the two MPs had told them they would be sacked for detaining the truck.

The witness was, however, stepped down until November 30 when his video recording will be played in court.

During the hearing, the legislators’ lawyer Okong’o Omogeni took issue with the allegedly signed contract between SGS Company manning the weighbridge and the government.

He said the document has not been presented in court and prosecution witnesses should stop commenting on the contract.

This was after a duty manager, Mark Wafula, said SGS had been contracted to act for the Kenya National Highways Authority on any transaction on the weighbridge.

The hearing continues on November 30.
