Transfer of 105 judges to proceed as court dismisses case

The High Court has dismissed a case challenging the transfer of 105 judges.

Justice George Odunga ruled that the petition, filed by lawyer Michael Osundwa, lacks merit, and it would not be in the interest of justice to deny the public its rights.

Odunga affirmed that the Chief Justice has legal powers to effect the disputed transfer.

In the recent past,

Odunga

has given the Executive and Parliament a tongue-lashing for disobeying court orders.

On April 19, the judge appointed the head of a judiciary unit, which puts government actions in check.

Odunga, who will head the Judicial Review at the High Court in Milimani, Nairobi, replaces Justice Weldon Korir who has been moved to Busia.

He ruled in December 2014 that the security laws, which had been passed in Parliament in a chaotic sitting, were illegal and needed closer scrutiny.

Appearing to exert the judiciary's independence over Parliament, Odunga shelved eight clauses in the contentious Bill passed on December 8 that year.

In changes announced by Chief Justice Willy Mutunga, top performing judge Mumbi Ngugi was moved from Milimani to Kericho.
