The CBK and Imperial Bank want the High Court in Mombasa to throw out an application made by a Mombasa businessman .
Ashok Doshi and his wife Amit waned the receivership to be declared illegal and the sh.1 billion in the bank paid.
Imperial Bank lawyer Philip Murgor told the court the section requires that no injunction be brought or commenced against an institution in receivership.
The ruling is on July 4.
