Court declines to issue orders against Cord anti-IEBC demos

The High court on Monday said it was not necessary for Cord leaders to appear .

The MPs want the court to hold Cord leaders Raila Odinga, Kalonzo Musyoka, and Moses Wetang'ula in contempt for violent anti-IEBC protests.

While delivering the ruling, Justice Joseph Onguto said he was not convinced there was need to order their presence.

But the judge granted an order to enjoin Cord's lawyer, Siaya Senator James Orengo as a respondent.

Through their lawyer, the MPs argue that Cord leaders have declined to obey an order issued on April 29 against violent protests.

They say that Cord failed to petition parliament, or initiate any complaint against IEBC officers. Instead, they marched to the electoral commission's officers at Anniversary Towers, blowing whistles while inciting a crowd of followers.

The legislators also took issue with the messages demonstrators conveyed on placards, and want Cord leaders held responsible for damages incurred during protests.

The MPs are

Moses Kuria (Gatundu), Ferdinand Waititu (Kabete), Kimani Ichung'wa (Kikuyu), Dennis Waweru (Dagoretti South), and Alice Ngang'a (Thika Town).

The matter will be heard on May 26.
