Alfred Mutua obtains orders stopping his arrest over corruption claims

Machakos Governor Alfred Mutua has obtained orders stopping his arrest over claims he illegally procured vehicles for the county.

Three Court of Appeal judges, led by GBM Kariuki, granted him the orders on Wednesday and set a hearing for next Monday.

DPP Keriako Tobiko last week issued orders for Mutua to be arrested and charged over the procurement of 15 Subaru Outbacks and a Toyota Land Cruiser.

The High Court had also allowed the Ethics and Anti-Corruption Commission to prosecute the Governor over the allegations.

Justice Isaac Lenaola said Mutua had not made a strong case against his prosecution.

The vehicles, second-hand Subaru Outbacks, bought at Xtreme Auto in Valley Arcade, Nairobi, were meant for the executive committee.

Mutua said his arrest over the matter was unlawful. He said his right to hold office is likely to be infringed if he is questioned by the EACC.

Through lawyer John Nyamu, the Governor said there would be no prejudice in stopping the EACC from investigating him.

He said the acquisition was done during the exit of local authorities and entry of county governments in 2013.
