White settler and MP in land dispute

A case in which Laikipia East MP Anthony Mutahi has been stopped from interfering with 20 acres in Nanyuki has been referred to the High Court in Nyeri.

The MP is in a tussle over the land with a white settler.

The land is on the Nanyuki-Doldol road, opposite British Army Training Camp.

The property has a house, 10 stables, three staff quarters, a garage, a store, a water tank and 15 horses.

Judge Joseph Onguto of the High Court at Milimani, Nairobi, yesterday said since the case had been initially filed in Nyeri, it should be concluded there.

On Wednesday, he ordered Inspector General of Police Joseph Boinnet to provide security to complainant Stuart Cunningham until the case is determined.

“The first respondent is hereby ordered to provide security to the petitioner, his family, employees, agents, friends, visitors and friends from the interference of Mutahi,” Onguto said.

In response, MP Mutahi said, in a consent before judge Jairus Ngaah in Nyeri, he is supposed to occupy 18 acres while Cunningham settles on two.

He accused Cunningham of not making a full disclosure of the facts of the case.

The suit is filed by lawyer Margaret Shava, saying Cunningham’s property was invaded on October 3 last year by an armed gang.
