Sh500 million plot probe to establish owner

The Directorate of Criminal Investigations has started a probe to establish the genuine owners of a disputed plot on Nairobi’s Ralph Bunche Road.

Six apartments on the half acre have been demolished and police evicted the caretakers and tenants in favour of one claimant.

The land valued at Sh500 million is near Nairobi Hospital.

It is registered as LR. No 209/289/1/3 Pittaway Flats.

It is being claimed by Thomas Murima Mutaha and Peter Gaitho Wallace as directors of Plovers Haunt Ltd – and also by Guy Spencer Elms and his wife Fiona Jane Elms.

A forensic Document Examiner’s Report referenced REF:CID/ORG/8/3/1/566 Plovers Haunt Ltd signed by John Muinde says signatures on a consent for Confirmation of Sale for Succession in cause number 955/2013 are different.

“In my opinion, the two sets of signatures (disputed and undisputed) are not similar and have not been made by the same author,” says Muinde, who is in charge of the CID Forensics Department.

Mutaha and Wallace in a letter to the DCI dated April 13, last year, claim that Guy Spencer Elms applied for a probate of succession No. 955/2013 using forged documents and request for a forensic check on the appended signatures.

In a letter from Plovers Haunt Ltd dated January 15 and addressed to Nairobi county commander Japheth Koome, the company says Mutaha and Wallace are the legitimate directors of Plovers Haunt Ltd.

“On or about November 18 last year, the company brought to the attention of the Registrar of Companies the fraud that had been committed by Guy Spencer Elms and his wife Fiona Jane Elms,” the letter says.

“The couple claim to be directors of the company vide a CR 13 signed and dated April 23 last year. It is our position that the CR12 dated December 6, 2015, indicates the two legitimate directors of the company.”

However, Elms says he knew the original owner of the land and one of the directors of Plovers.
