Two foreigners in fake currency case seek to be released on bail

TWO foreigners accused of having Sh110 billion in fake currency have gone to the High Court to challenge a magistrate’s decision to deny them bail.

Mohammed Sani, alias Dr Mustafa, and Ousman Bako, both West Africans, moved to the High Court through lawyers Steve Kimathi and Kethi Kilonzo.

The duo have denied having forgery papers on January 14 and 15 at Diamond Park II estate in Nairobi.

They say the prosecution has not tabled evidence why they should be denied bail.

Justice Luka Kimaru certified the case urgent and directed the application to be heard on February 8.

Kethi told the judge the right to bail is constitutional.

The prosecution opposed their release, saying the offence is serious and they can flee because they are not Kenyans.

Sani and Bako were charged before Milimani chief magistrate Daniel Ogembo, who denied them bail.

Ogembo said he considered the magnitude of the case and when fake money enters into circulation, it may create a problem to the economy.
