Shollei charged anew with abuse of office

Judiciary former Chief Registrar Gladys Shollei yesterday denied fresh charges related to irregular payments for the construction of Mavoko law courts.

She is accused of abuse of office and failure to comply with procurement laws.

Shollei has another case on buying a house for the Chief Justice.

She denied the charges and was ordered to pay Sh300,000 bail or deposit a Sh1 million bond, with surety of a similar amount.

The additional charges were approved by Director of Public Prosecutions Keriako Tobiko following recommendations by the Ethics and Anti-Corruption Commission.

Shollei will face the charges alongside seven others.

They are former deputy chief registrar Kakai Kissinger, Martin Okwata, Benedict Omollo, Wycliffe Ombunde, Nicholas Okemwa, Nicholas Mbeba and Thomas Atak.

The prosecution said Shollei awarded Timsales Ltd the tender to construct the court without following procurement procedures. It led to the loss of Sh18.3 million.

Shollei, Kissinger, Otieno and Abonyo are accused of using their offices to improperly confer a benefit to Timsales by varying the terms and conditions of a contract without approval of the tender committee.

The prosecution says this violated public procurement and disposal regulations.

The seven face a charge of abuse of office for awarding Timsales the tender to construct Runyenjes court station without following procurement procedures. It led to the loss of Sh18.3 million.

They are also accused of violating procurement laws by awarding a direct tender to Timsales and increasing the down payment from the company from 10 per cent to 50 per cent.

Kissinger faces another charge of abuse of office for authorising payment of Sh150 million to Timsales to construct courts in Mavoko and Garsen.

The case will be mentioned on February 9.
