Mutunga summons lawyers over Rawal retirement case

Chief Justice Willy Mutunga has summoned lawyers in a case filed by his deputy Kalpana Rawal.

The CJ ordered the lawyers to appear before him on Monday at 2.30pm even though the case is listed before the Court of Appeal for hearing on Tuesday, January 12.

One of the lawyers said he was informed on Saturday evening but does not know the "purpose of the urgent meeting".

Rawal is appealing against a decision of the High Court that she retires at age 70 instead of 74.

The deputy CJ who turns 70 on January 15, to advertise her position and direct her to proceed on terminal leave.

The matter came up before Appellate judges GBM Kariuki, Festus

Azangalala and Fatuma Sichale on December 28 2015.

her bid challenging retirement at age 70, after judges ruled she was appointed and took oath of office under the new constitution.

The bench was later dissolved and another comprising of Justice Sichale, Otieno Odek and Sankale Ole

Kantai was constituted.

and Jamila Mohammed were added to the bench to hear the matter alongside Odek, and

Kantai, who are to hear the matter on Tuesday.
