Sh110m KVDA dam halted in tender row

The Public Procurement Administrate Review Board has stopped work on a Sh110 million dam over a tender row.

The dam was being built by the Kerio Valley Development Authority.

The board will sit in Eldoret on January 14 to hear a procurement dispute filed against KVDA on the awarding of a tender to build the Embobut Multi-Purpose Project in Elgeyo Marakwet county.

The Sosian Energy Consortium requested the procurement board to review the tender awarding.

“We have decided to devolve some of the disputes. That is why we will sit at the county commissioner’s office in Eldoret to hear the KVDA matter,” procurement board chairman Paul Gicheru said.

He said the board is devolving the hearing of the disputes as one way of educating the public on their existence and mandate.

Sosian argues they had submitted a valid bid for the project on on March 16 last year, after KVDA advertised the tender.

They say KVDA invited them last June 9 to submit a detailed proposal because it had scored 90 per cent upon evaluation.

Sosian says it had been listed among three other companies to proceed to the second qualification stage.

The company says when the tenders were finally opened last October 30, they were the lowest financial bidders but on December 23, they received a letter from KVDA dated December 14, indicating their bid was not successful.

The firm says they were not given full details why their bid was not successful.

Sosian says KVDA acted against the Public Procurement and Disposal Act 2005 and had breached the law.

The company filed its complaint through Mbindyo and Company Advocates.

They want the board to cancel the tender award to another bidder, who has not been named in the documents.

The complaint is copied to KVDA CEO David Kimosop who has been summoned to the procurement board to explain the decision
