Court allows Olive Mugenda to stay in office for 14 days

A court has reinstated Olive Mugenda as Kenyatta University VC pending the determination, in two weeks, of a case on her terminal leave.

The Employment and Labour Relations Court stayed the order by Justice Helen Wasilwa for the VC to take the six-month leave to allow her replacement.

Justice Nduma Nderi said in a ruling on Tuesday that the VC is expected to appear in court on January 18 for the determination of the case.

High court judge Nzioka Makau declined to issue orders allowing her to pursue an appeal against the terminal leave.

Makau further declined to give audience to the University's Council.

Council chairperson Ratemo Michieka had said the Labour Court's advice for the VC to proceed on leave "was not an order".

Michieka announced that Mugenda would remain in office, contrary to the court's directive that she take leave pending the determination of a case which seeks her removal.

Activist Okiya Omtatah, who filed the petition, said Mugenda had served her term and was required to vacate office.

Omtatah also wanted the position "properly advertised as per the requirements".

Mugenda is set to retire in March. She was appointed Vice Chancellor in 2007 and reappointed by former president Mwai Kibaki in 2012 for another five-year term.
