Committee hearing Linturi's case meets Tuesday evening to lay ground rules

Hearings will commence on Wednesday at 9 am

The Select Committee on the proposed dismissal of Cabinet Secretary for Agriculture and Livestock Mithika Linturi is expected to hold a pre-trial hearing on Tuesday at 5 pm.

The hearing at the Mini Chamber, County Hall will be attended by all concerned parties.

These include the CS and his team and Bumula MP Jack Wamboka and his team. Wamboka sponsored the impeachment motion.

The purpose of the Tuesday evening sitting will be to lay the ground rules for the hearings that commence on Wednesday, May 8, 2024 at 9 am.

The National Assembly approved a Motion for the dismissal of CS Linturi on May 2.

On the same afternoon, an 11 Member Select Committee was formed, consisting of Naomi Waqo (Marsabit ) - Majority Party Chief Whip, Robert Mbui (Kathiani) - Deputy Leader of the Minority Party, Rachael Nyamai (Kitui South), Samuel Chepkonga (Aionabkoi), Gitonga Murugara (Tharaka) and Tom Kajwang’ (Ruaraka).

Others are Malulu Injendi (Malava), Njeri Maina (Kirinyaga), Kassim Tandaza (Matuga), Catherine Omanyo (Busia) and Yusuf Farah (Wajir West).

The committee in its first sitting proceeded to elect Waqo as chairperson and Mbui as vice chairperson.

In his impeachment motion, Wamboka alleges that Linturi is guilty of gross violation of the Constitution by failing to undertake public participation before proceeding with the procurement and distribution of fertiliser.

Wamboka listed three grounds which are alleged to be a gross violation of the Constitution or any other law, serious reasons to believe the CS has committed a crime under national law and gross misconduct.

If the select committee finds the allegations are unsubstantiated, no further proceedings shall be taken.

If it finds the allegations are substantiated, the National Assembly shall afford the CS an opportunity to be heard.

The National Assembly should conclude the debate on the report of the Select Committee within 14 days of the giving of the Notice of Motion for the adoption of the committee’s report.

The House shall set a date on which the CS shall appear before members to provide further clarifications and/or respond to matters arising from the findings of the committee.

If the Motion to adopt the report of the Select Committee obtains the support of the majority of the House membership, which is capped at 176 Members, it will be ushered to the next stage.

If carried by that number, the motion shall be deemed adopted by the house and the Cabinet Secretary shall be regarded impeached from office.

The Speaker shall promptly deliver the resolution to the President who shall dismiss the Cabinet Secretary.
